Instructions for Filing Summary Release from Administration
Eligibility Requirements
A Summary Release from Administration may be filed if:

The value of the estate is $5,000.00 or less, and the applicant paid the funeral bill
or is obligated in writing to pay the funeral bill, or -
There is a surviving spouse, the assets do not exceed $45,000.00, the spouse is entitled
to 100% of the family allowance, and the funeral bill has been prepaid or the surviving
spouse is obligated to pay the funeral bill.
What You Need When Filing
- The original Will if the deceased person had one.

Receipt of a paid funeral bill, or if not available, the funeral bill. The receipt or funeral bill
must show the applicant’s payment or obligation to pay the funeral and burial expenses. - Title(s) of automobiles, bank account numbers, stock certificate numbers, insurance policy numbers, and similar records.
- The market value of real property as found in Belmont County Fiscal Office property records.

The market or book value of any motor vehicle, ATV, motorcycle, personal watercraft, snowmobile,
trailer, utility vehicle, power boat, sailboat, motor home, camping trailer, truck camper, and similar assets. - A copy of the death certificate.

Filing Fees
- The filing fee is $150.00 (with a Will) or $100.00 (without a Will).
- If you use a credit card, a 3% charge will be added.
- Transferring real estate may require an additional fee.
